Regulatory and Administrative Law
Massimo Colicchia is the Head of the Regulatory and Administrative Law Team. He regularly represents domestic and multinational Clients in a large number of high profile, complex and often business-critical transactional and litigation regulatory processes, helping them navigate both established and emerging regulatory regimes, with a particular focus on Energy & Renewable Energy, Telecommunications and Pharmaceuticals Healthcare & Medical Devices.
Massimo Colicchia advises on all aspects of domestic EU and international regulated public and utilities procurement law, both on transactional and contentious levels and is praised for his shrewd understanding of the substantial and trial principles, rules, and regulations, which enables him to provide tailored advice on sophisticated government contracting and public procurement issues, from bid strategy through to potential challenge, including preparation of strategic alliance agreements, bid protests and challenges, contract administration and claims.
He combines sector knowledge and technical expertise to assist domestic and international Clients in negotiating a wide array of real estate development litigation and planning disputes before local and national Administrative Courts.
Environmental Law
Massimo Colicchia also heads the Environmental Law Team and regularly represents domestic and multinational Clients in a large number of high profile, complex and often business-critical transactional and litigation regulatory matters, including transactional, land use, and regulatory approvals, permitting, compliance, enforcement actions, occupational health and safety, toxic tort and litigation.
He has long-standing experience in advising on solid and hazardous waste management and recycling issues, on-site and off-site response actions, waste facility permitting, site investigations, and compliance issues. He routinely represents clients who find themselves entwined as defendants in private party or government litigation, whether as past or present owners or operators of clean-up sites, or generators of hazardous substances that are the subject of private or government response actions.
Massimo Colicchia routinely advises with respect to requirements for permits, variances, and exemptions for new or existing facilities or industrial processes; hazard communication and chemical process safety; including:
- Negotiate environmental aspects of corporate transactions and structure purchase, sale and merger documentation to allocate and mitigate environmental risk in order to protect clients from unanticipated post-closing responsibilities.
- Provide counsel regarding real estate transfers, site characterization and remediation, development projects and associated land use issues, including the negotiation of environmental deed restrictions, conservation easements and environmental insurance policies.
